1. Agreement
These terms are an agreement between you and SetForge (“SetForge”, “we”, “us”) for your use of the SetForge app and setforge.com.au (the “services”). By creating an account or using the services you agree to them. If you don't agree, please don't use SetForge. Our privacy policy explains how we handle your information.
2. Health and safety
SetForge gives general training guidance, not medical advice. Programs, prescriptions, training maxes, estimated maxes and reminders are generated automatically from the numbers you enter. They don't take account of your medical history, injuries or individual circumstances.
- Check with a doctor or qualified health professional before starting a new exercise program, especially if you have a medical condition, an injury, or are pregnant.
- Use correct technique, appropriate safety equipment (such as safety bars, collars and a spotter) and loads you can handle safely. Stop if you feel pain, dizziness or discomfort.
- You decide what you lift. You're responsible for checking that a suggested weight is safe for you before you attempt it.
3. Your account
- You need to be at least 13 to use SetForge, and if you're under 18 you need a parent's or guardian's permission.
- Keep your sign-in secure. You're responsible for activity on your account. Tell us straight away if you think someone else has access to it.
- Opt-in reminders with explicit language are only for users aged 18 or over.
4. Free trial and subscription
- New accounts get every feature free for 2 months. After the trial, SetForge Monthly costs A$3.99 per month (or the equivalent in your local currency), charged to your Apple Account or Google Play account.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the period ends.
- Manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your SetForge account doesn't cancel the subscription. Cancel during the free trial and you won't be charged.
- Payments and refunds are handled by Apple or Google under their terms. Request a refund from the store you bought from.
- We may change prices. A price change applies from your next renewal after you've been notified, and you can cancel before it takes effect.
5. Your licence to use SetForge
We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, under these terms and the usage rules of the store you downloaded it from. Please don't copy, modify, reverse engineer, resell or misuse the services, interfere with their security, or use them to break the law.
6. Your content
Your workouts, notes, photos and other data belong to you. You give us permission to store, copy and process them only as needed to provide the services to you (for example, to sync them across your devices). You can export your data or delete your account at any time. Custom exercise names and notes must not be unlawful or infringe anyone else's rights.
7. Our content
The app, its design, the SetForge name and logo, the coaching rules and the website are owned by us or our licensors and are protected by intellectual property laws. Exercise descriptions and images in the exercise library may come from third-party providers and remain theirs.
8. Third-party services
Some features connect to services we don't control, such as Sign in with Apple, Google sign-in, the app stores, and Hevy (if you choose to import). Their own terms apply to your use of them, and we're not responsible for their availability or content.
9. Changes and availability
We're improving SetForge all the time, so features may change. We aim to keep the services available, but they may sometimes be interrupted for maintenance or reasons outside our control. Because your data is stored on your device first, you can usually keep logging workouts offline while the servers are unavailable.
10. Australian Consumer Law
Our services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law or any other law that can't lawfully be excluded.
11. Limitation of liability
To the extent permitted by law, and apart from the guarantees in section 10, the services are provided “as is”, and we're not liable for any indirect or consequential loss, or for injury arising from exercise you choose to perform. Where our liability for a failure to comply with a consumer guarantee can be limited, it's limited, at our option, to supplying the services again or paying the cost of having them supplied again.
12. Ending these terms
You can stop using SetForge and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaches these terms, after giving notice where it's reasonable to do so. Sections that by their nature should survive (such as 6, 7, 10 and 11) continue to apply.
13. Apple App Store terms
If you downloaded SetForge from the Apple App Store, these terms also apply:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your licence is limited to using the app on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any claim that the app infringes a third party's intellectual property rights.
- You confirm you're not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you're not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Governing law
These terms are governed by the laws in force in Australia, and you and we submit to the non-exclusive jurisdiction of Australian courts.
